As Commander-in-Chief of the Armed Forces, President Obama did what the American Military Credo called for and brought Sgt. Bowe Bergdahl home. President Obama said, “We don’t leave our men or women in uniform behind.”
While serving in a combat zone in Afghanistan, it was alleged that Sergeant Bergdahl left his post and went AWOL. Was he derelict in his duty?
Is he a Traitor, Deserter, or was he an undercover hero? Pundits have been seeking answers to these questions.
As a Korean Veteran who served in a combat zone and specialized in Court-Martials, I want to share my insight on a “presumptive conclusion” to the Bergdahl Matter.
Sergeant Bergdahl has not been charged with violating any Articles of the Uniformed Code of Military Justice yet, but I am reasonably sure Sgt. Bergdahl was placed is a “deserted” status by his combat unit after he had been absent from his unit for 30 days.
What are the allegations against Bergdahl?
- Soldiers in his combat unit alleges he was derelict in his duty.
- He left his military post, left all his combat gear behind, and went AWOL. While being AWOL from his unit, in his own defense, Bergdahl stated that he was captured by the Taliban, put in a cage after a couple of attempts to escape, and held prisoner for five years.
Now that Bergdahl is back home with the Army, the Criminal Investigation Division (CID) of the Army will conduct a thorough investigation into the allegations against Bergdahl to determine if they are true. If the allegations are true, Bergdahl will be court- martialed.
When Sgt. Bergdahl went AWOL, a disposition must have been made in the unit’s Morning Report. He would have been taken off the Duty Roster and all of his Army benefits would have been forfeited and his family would have been notified of these actions. Bergdahl would have then been placed in a “deserted” status and the Provost Marshall’s Office would have had orders to arrest him.
If Sgt. Bergdahl had been caught and arrested by the Military Police and the allegations against him had been proven to be true, Bergdahl would have been court- martialed under the Articles of the Uniform Code of Military Justice (UCMJ.)
If proven guilty after a court-martial tribunal, Bergdahl would forfeit all his pay, be stripped of his rank and all GI benefits. He would then be confined in Fort Leavenworth Kansas to serve out the sentence mandated under the UCMJ and Dishonorably Discharged from the Service of the United States. This is my “presumptive conclusion” to the “Bergdahl matter” once and forever.
